10. International Data Transfers

OneBallr may transfer users' personal data outside of the United States due to the use of hosting, storage and processing services provided by third parties that operate servers located in different countries. These transfers are necessary to ensure the continued operation of the platform and to provide an efficient user experience. Although OneBallr is based in Germany, the technological infrastructure it uses may result in data being stored or processed in jurisdictions with data protection laws that differ from those of Germany and the European Union.

OneBallr is committed to ensuring that all international transfers of personal data comply with applicable data protection regulations, including appropriate security measures to safeguard user information. This includes, but is not limited to, implementing standard contractual clauses, assessing the adequacy of data protection in the receiving country, and complying with applicable privacy standards on third party services.

By using OneBallr, users consent to the transfer, storage and processing of their data on servers located outside their country of residence, acknowledging that such transfers are necessary for the operation of the platform. OneBallr undertakes to take all reasonable steps to protect the integrity and security of personal data during such international transfers.

11. Privacy Rights

Users of the OneBallr application are entitled to exercise a range of rights in relation to their personal data. These rights are granted under applicable data protection laws, including those in Germany and the European Union, as well as other international privacy frameworks where applicable. The application is committed to facilitating the effective exercise of these rights and ensuring that users maintain control over their personal data.

Users may exercise the following rights:

  • Right of Access: Users have the right to obtain confirmation as to whether their personal data is being processed and, where that is the case, to request access to such data, including information about the purposes of processing, categories of data involved, and recipients of the data.
  • Right to Rectification: Users have the right to request the correction of inaccurate or incomplete personal data concerning them without undue delay.
  • Right to Erasure (Right to be Forgotten): Users may request the deletion of their personal data where such data is no longer necessary for the purposes for which it was collected, where consent has been withdrawn, or where the data has been unlawfully processed.
  • Right to Restriction of Processing: Users have the right to request the limitation of the processing of their personal data in certain circumstances, such as where the accuracy of the data is contested or where the processing is unlawful but the user opposes deletion.
  • Right to Data Portability: Users have the right to receive the personal data they have provided in a structured, commonly used, and machine-readable format and, where technically feasible, to have such data transmitted to another controller.
  • Right to Object: Users have the right to object, on grounds relating to their particular situation, to the processing of their personal data, particularly where such processing is based on legitimate interests or is carried out for direct marketing purposes.
  • Right to Withdraw Consent: Where data processing is based on consent, users have the right to withdraw their consent at any time, without affecting the lawfulness of processing carried out prior to such withdrawal.
  • Right Not to Be Subject to Automated Decision-Making: Users have the right not to be subject to decisions based solely on automated processing, including profiling, that produce legal effects or similarly significant effects, except where such processing is permitted under applicable law.
  • Right to Lodge a Complaint: Users have the right to lodge a complaint with a competent data protection authority, particularly in the country of their habitual residence, place of work, or place of the alleged infringement, if they consider that the processing of their personal data infringes applicable data protection laws.

To exercise any of the rights described above, users may submit a request by contacting the application operator through the contact details provided in this Privacy Policy. Requests should include sufficient information to verify the identity of the requester and to clearly specify the right being exercised. Where necessary, additional information may be requested to confirm the identity of the user and ensure the security of personal data.

Requests will be processed without undue delay and, in any event, within a maximum period of one (1) month from the date of receipt. This period may be extended by up to two (2) additional months where necessary, taking into account the complexity and number of requests. In such cases, the user will be informed of the extension and the reasons for the delay within the initial one-month period.

Where a request is manifestly unfounded, excessive, or repetitive, the application operator reserves the right to refuse to act on the request or to charge a reasonable fee based on administrative costs, in accordance with applicable data protection standards.

Users may also exercise certain rights directly within the application, such as deleting their account through the available functionality, without the need to submit a formal request.

12. Account Deletion

Users may delete their account at any time through the “Delete Account” function available within the OneBallr application. Upon deletion, the account is deactivated and no longer accessible or visible within the app; however, the application operates a soft deletion system, meaning that the account is marked as deleted rather than permanently removed from the database. Certain associated data may be retained in a restricted, non-active state in order to preserve the integrity and consistency of the platform, including game history, statistics, rankings, notifications, and other relational data. Such data is not used for active purposes and may be anonymized or further restricted in accordance with internal data management practices. Account deletion is irreversible, and users will not be able to recover their data once the process is completed.

13. Children's Online Privacy Protection

The OneBallr application is designed to be accessible to a general audience and may be used by individuals aged 4 years and older, in accordance with its app store age rating. However, the application recognizes the importance of protecting the privacy of children and is committed to implementing appropriate safeguards when personal data of minors is involved.

Where users are considered children under applicable data protection laws, including those within the European Union and Germany, the processing of personal data may be subject to additional requirements, including the involvement of a parent or legal guardian where necessary. In particular, where the provision of personal data requires consent under applicable laws, such consent must be given or authorized by the holder of parental responsibility if the child has not reached the legally required age for independent consent.

The application does not knowingly collect excessive personal data from children and limits data collection to what is necessary to provide the core functionalities of the service, such as account creation, gameplay, and basic profile customization. No sensitive personal data is intentionally requested from minors.

Parents or legal guardians who believe that a child has provided personal data without appropriate authorization may contact the application operator to request review, correction, or deletion of such data. The application will take reasonable steps to verify the request and, where appropriate, promptly delete or restrict access to the relevant data.

The application may display advertising through third-party services. Where required by applicable laws, appropriate measures will be taken to ensure that such advertising practices are adapted to children, including limitations on personalized advertising where applicable.

The application encourages parents and guardians to supervise children’s use of digital services and to educate them about safe and responsible online behavior.
